Portugal Announces Positive Amendments to Birthright Citizenship Laws
Effective from the 11th of November 2020, children born to parents holding foreign passports will qualify for a Portuguese Citizenship upon birth- granted that one of the parents has resided in Portugal for at least year, legally or otherwise. This development was announced by President Marcelo Rebelo de Sousa on 3rd November 2020 after several months of debate on the matter. Under the new amendments, the time period of prior residence in Portugal for a foreign passport holding parent is significantly reduced. Portugal has been offering citizenship upon birth to migrant children born in Portugal for a long time, however, the former version of the law required the residency of one parent for a period of at least 2 years to qualify.
This is excellent news for those planning to enter into the Portugal Golden Visa Program. The amendment still does require one of the parents to have held the Portugal Golden Visa for at least a year, even if only the seven-day physical appearance provision has been met by the respective parent. The Portugal Golden Visa Program was a part of the Portuguese government’s efforts to welcome foreign investors in Portugal- and now more welcoming towards their families as well. The Golden Visa program has been a major success since its launch in 2012, with 9254 investors and 15,864 family members benefiting from the program.
